No Purchase Necessary to Enter or Win. The entry period for the Magnolia House 12 Days of Christmas Contest (the “Contest”) has 2 Contest days.

• Day 2 (December 13) starts at 10 am EST and ends at 11:59 PM (EST) on December 14th, 2020 (the “Contest Entry Period”). Winners will be selected and contacted on December 16th, 2020.
• Day 9 (December 20) starts at 10 am EST and ends at 11:59 PM (EST) on December 21st, 2020 (the “Contest Entry Period”). Winners will be selected and contacted on December 23rd, 2020.

The Contest sponsor is JAR Consulting Inc. carrying on business as Magnolia House Spa Salon Boutique (“Magnolia House” or the “Contest Sponsor”).

There are two ways you can enter the contest:

2. ODDS OF WINNING

The Contest Sponsor is Magnolia House. The odds of winning depend on the number of Entries received.

3. CONTEST RULES COMPLIANCE

This contest will be run in accordance with these rules, subject to amendment by Magnolia House. Contestants must comply with these rules, and will be deemed to have received, understood and accepted the rules by participating in the contest. The terms of this contest, as set out in these rules, are not subject to amendment or counteroffer, except as set out herein.

Magnolia House reserves the right to amend these Rules as necessary or terminate the Draw at any time without liability to any Entrant, including Potential Winners and the Winner. In the case of termination of the Draw before the end of the Draw Period, Magnolia House reserves the right to, in its sole discretion, select a Winner from all eligible entries received prior to the termination of the Draw.

This Contest and these Rules shall be exclusively governed by and construed in accordance with the laws of the province of Ontario and the laws of Canada applicable therein. The Contest is subject to all applicable laws and regulations. By entering the Draw, Entrants irrevocably submit to the non-exclusive jurisdiction of Ontario for the purpose of any suit, action or proceeding arising in relation to the Contest, including the interpretation of the Rules.

Failure to comply with these Rules may result in disqualification from the Draw. Any materials used in this Draw, including Entries, which have been tampered with, forged, reproduced or not legitimately obtained, are unintelligible, illegible, damaged or which contain or reflect printing, production, distribution or other errors may, in the sole discretion of Magnolia House, be judged void and the Entrant disqualified. Entrants further agree to comply with and be bound by the decisions of Magnolia House, which will be final and binding in all respects. Magnolia House reserves the right in its sole discretion to disqualify any individual, including those selected as Potential Winners or the Winner, suspected of: (a) having provided false or misleading information in relation to the Draw, whether in the entry process or otherwise; (b) tampering or attempting to tamper with the entry process or the operation of the Contest; (c) violating the Rules; (d) violating any terms of service, conditions of use or general rules or guidelines of any property or service of Magnolia House or its affiliates; or (e) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person in relation to the Draw, the Draw entry process or Winner selection.

4. ELIGIBILITY

The Contest is open to residents of Ontario who have reached the age of majority in Ontario except employees, staff, directors, officers and owners of the Contest Sponsor, its affiliates, and any advertising and promotional agencies, promotional partners and fulfillment houses whose services have been provided in relation to the contest, members of such individuals’ respective immediate families (parents, spouse, siblings and children) and persons living in the same household as such individuals, whether related or not. The Contest Sponsor shall have the right at any time to require proof of identity and/or eligibility to enter the Contest.  Failure to provide such proof may result in disqualification.  All personal and other information requested by and supplied for the purpose of the Contest must be truthful, complete, accurate and in no way misleading.  The Contest Sponsor reserves the right, in its sole and absolute discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

5. DRAW

A random draw will be made by a representative of Magnolia House from all Eligible Entries received during the giveaway period. One username will be selected at random through a draw. The selected entrant will be contacted by direct message on social media. If a selected entrant cannot be reached within 48 hours of contact by Magnolia House, declines the prize, or fails to return a Release of Liability as specified below, Magnolia House reserves the right, at its sole discretion, to select another entrant or to cancel the prize.

If the Entrant selected has entered an Eligible Entry and otherwise complied with these Rules, that Entrant (the “Potential Winner”) will be announced on Magnolia House website. Magnolia House will contact the winner to arrange for prize pick-up. If Magnolia House, acting reasonably, cannot contact the first Potential Winner selected within five business days of the first notification attempt, another Entry will be drawn.

6. DECLARATION AND RELEASE

By entering the Draw, Entrants agree to release and hold harmless Magnolia House Spa Salon Boutique its affiliates, employees, directors, officers and owner, advertising, promotional agencies, promotional partners, contest sponsors and fulfillment houses from any and all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to person and property, including death or property damage, resulting in whole or in part, directly or indirectly, from participation in the Draw, including without limitation, acceptance, possession, use or misuse of the Prize or any Substitute Prize(s), including preparing for, participating in, and/or travelling to any Prize or Substitute Prize-related activity.

Before being declared the Winner and claiming the Prize the Potential Winner must sign a Declaration and Release including a publicity release in a form prescribed by Magnolia House, confirming compliance with these Rules, acceptance of the Prize as awarded, releasing Magnolia House its affiliates, employees, directors, officers and owners, advertising and promotional agencies, contest sponsors, promotional partners and fulfillment houses from liability and permitting Magnolia House to use his or her image and name for promotional purposes. By accepting a prize, winners consent to the provision and use of their name, statements, and photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice.

If the Potential declines the prize or fails to return a Release of Liability as specified below, he/she will forfeit their prize and another entrant will be selected.

No responsibility is assumed by Magnolia House for the Winner’s medical or physical condition, or for cancelled, delayed, suspended, unavailable or rescheduled spa visits, treatment services or products. The Prize must be accepted as awarded. Except at Magnolia House sole discretion, the Prize, is non-transferable and has no cash surrender value, in whole or in part. Magnolia House reserves the right to substitute the Prize, with a prize or prizes of equivalent value (a “Substitute Prize”) in its sole discretion. All Substitute Prizes must be accepted as awarded. The Winner must make a reservation for a spa visit to redeem the Prize, in accordance with Magnolia House normal reservation procedures.

7. ENTRIES AND OTHER CONTEST MATERIALS

Magnolia House takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries or for typographical or other production errors.

All contest materials, including Entries, become the property of, and are subject to verification by, Magnolia House and none will be acknowledged or returned.

8. ADVERTISING ERRORS

Magnolia House is not responsible for any errors or omissions in printing or advertising this contest.

9. PRIVACY

Any personal information submitted as part of an Entry will be subject to and only used in accordance with these Rules and our Privacy Policy which may be found at Privacy Policy

10. PRIZE

Participants are eligible to win one of:

The prize does not include travel to and from Magnolia House; services or products the Winner may request or purchase on a spa visit, tips or other gratuities; and any other items of a personal nature or related to accepting (the Prize). The prize must be picked up by the Winner by appointment with a Magnolia House employee, as indicated in the Declaration and Release form. Identification must be presented and match the name and address of the winning entry form. The name and photo of the Winner will be published in the Magnolia House e-newsletter and/or on its website, www.magnoliahousespa.com.
